Daniel Warmus, of Alden, New York, traveled to Washington, D.C. for Trump's Jan. 6, 2021 rally wearing a black sweatshirt reading "CNN is Fake News" and a "Stop the Steal" pin, then entered the U.S. Capitol through the Senate Wing doors at about 2:17 p.m. during the riot, walking toward the Crypt and up a staircase near the Memorial Door before reaching the Rotunda, where he dropped an unknown dark object on a statue, and remaining inside until 2:33 p.m.; he was identified after a tipster reported overhearing him bragging about the riot, including that he had smoked marijuana inside the Capitol and refused an officer's order to leave, while showing a video of it at his dentist's office. He pleaded guilty to one charge, parading, demonstrating, or picketing in a Capitol building, with other charges, including violent entry and disorderly conduct, dismissed. He became the first Western New Yorker sentenced to jail time for the riot when a federal judge sentenced him on 9/27/2022 to 45 days of incarceration, 24 months of probation, $500 in restitution, a $10 special assessment, and 60 hours of community service.
