Convicted of
Eliel B. Rosa, 53, of Midland, Texas, an asylee from Brazil who had worked for eight years toward U.S. citizenship, traveled to Washington, D.C. with Jenny Cudd for the Jan. 6, 2021 "Stop the Steal" rally; after initially returning to their hotel, the pair went back to the Capitol upon hearing that Vice President Mike Pence would not overturn the election results and entered the building, getting close enough to the Speaker's Lobby that Rosa said he heard the shot that killed Ashli Babbitt. He turned himself in to the FBI three days after the riot. He pleaded guilty to one charge, parading, demonstrating, or picketing in a Capitol building, with other charges, including felony obstruction, dismissed. He was sentenced on 10/12/2021 to 12 months of probation, 100 hours of community service, a $10 special assessment, and $500 in restitution.
