Convicted of
James Little roamed the third-floor Senate Gallery of the U.S. Capitol during the Jan. 6, 2021 riot, taking photographs and sending messages to family and friends. He pleaded guilty to a misdemeanor count of parading, demonstrating, or picketing in a Capitol building. He was sentenced on 3/14/2022 to 60 days of incarceration and 3 years of probation, a $10 special assessment, and $500 in restitution; on appeal, the D.C. Circuit held that the statute did not authorize a split sentence of both imprisonment and probation, and his sentence was vacated and remanded. He was resentenced on 1/25/2024 to 120 days of incarceration with credit for the 60 days already served and additional credit for time spent on probation, along with the original $10 special assessment and $500 in restitution; the appeals court later rejected his double-jeopardy challenge to the resentencing.
