As two-term President of Honduras from 2014 to 2022, Hernández participated in a corrupt drug-trafficking conspiracy spanning approximately 2004 through 2022. He accepted millions of dollars in bribes from major trafficking organisations — including a $1 million contribution from Sinaloa Cartel leader Joaquín "El Chapo" Guzmán, personally delivered in 2013 to finance his presidential campaign — in exchange for using his presidential powers to shield drug traffickers from investigation and prosecution. Hernández and his co-conspirators are estimated to have facilitated the movement of more than 400 tons of cocaine destined for the United States through Honduras. A ledger seized from drug trafficker Nery Orlando López listed $440,000 in payments to "JOH y su gente" (JOH and his associates). His brother, Honduran congressman Tony Hernández, had already been convicted in the same trafficking network in 2019 and sentenced to life plus 30 years in 2021. Prosecutors described Juan Orlando Hernández as "one of the most culpable defendants ever prosecuted in the United States." He was convicted by a unanimous jury on March 8, 2024, following a three-week trial in the Southern District of New York before U.S. District Judge P. Kevin Castel. He had been extradited from Honduras — where he was arrested at US request in February 2022 — on April 21, 2022, weeks after leaving office.

45 years federal prison plus an $8 million fine. Sentenced June 26, 2024 — a date that coincided with International Day against Drug Abuse and Illicit Trafficking — by U.S. District Judge P. Kevin Castel in the Southern District of New York. Hernández had been in US federal custody since his extradition in April 2022. Trump announced a "full and complete pardon" on November 28, 2025, formally signing it on December 1, 2025, when Hernández was released — having served approximately 3.5 years of his 45-year sentence.
