Robert Henry Harshbarger Jr., a licensed pharmacist, was convicted of substituting an unapproved drug for a medically necessary treatment prescribed to kidney dialysis patients. Instead of dispensing the FDA-approved iron sucrose — used to treat iron deficiency anemia in dialysis patients — Harshbarger substituted a cheaper version of the drug imported from China that had not been approved by the US Food and Drug Administration, while billing as though the approved product had been dispensed. He pleaded guilty to one count each of introducing misbranded drugs into interstate commerce and health care fraud. Harshbarger is the husband of Rep. Diana Harshbarger (R-TN); his pardon in November 2025 was not publicly announced by the White House and came to light only through a posting on the Justice Department's Office of the Pardon Attorney website.
Original sentence
Harshbarger was sentenced on November 4, 2013, to 48 months' imprisonment, a $25,000 fine, $848,504.34 in restitution, and forfeiture of $425,000. He received his pardon more than a decade after sentencing.
