Suzanne Kaye

Kaye, a resident of Boca Raton, Florida, was convicted by a jury of transmitting an interstate threat to injure, a violation of 18 U.S.C. § 875(c). The case arose in the aftermath of the 2021 certification riot in Washington, D.C.: the FBI received a tip on January 16, 2021 suggesting Kaye may have been present at the riot or had knowledge of individuals involved. Agents contacted her by phone on January 28 to request an interview, and days later Kaye posted videos online in which she threatened to shoot FBI agents if they came to her door. She was not charged with any riot-related offense and testified at trial that she did not own any guns and did not intend the statements as genuine threats. The jury convicted her nonetheless.
