Theodore Middendorf
Convicted of
Theodore Middendorf, 36, of McLeansboro, Illinois, made arrangements with co-defendant Justin LaGesse in December 2020 to travel to Washington, D.C., then entered the U.S. Capitol at about 2:51 p.m. through a broken window next to the Senate Wing Door during the Jan. 6, 2021 riot after LaGesse helped him climb through; the pair then struck a large Capitol window with their flagpoles, causing over \$41,000 in damage, before moving through the Crypt and the Hall of Columns and leaving through a south-side door. He was arrested on January 17, 2024 and pleaded guilty to one felony charge, destruction of government property, with other charges, including engaging in physical violence and parading, demonstrating, or picketing in a Capitol building, dismissed.
Original sentence
Sentencing had been scheduled for 2/12/2025, but the court granted the government's motion to dismiss the case with prejudice following the Jan. 20, 2025 pardon before he could be sentenced, so no sentence was imposed on the Capitol riot charge.
