Thomas Harlen Smith, 45, of Mathiston, Mississippi, traveled to Washington, D.C. on January 5, 2021 to attend Donald Trump's rally the next day, picking up his cousin from Alabama along the way; during the Jan. 6, 2021 riot that followed, he pushed to the front of a group of rioters at the Lower West Terrace and thrust a flagpole "like a spear" five times trying to break a window next to the doors, then surged through the door as he and others pushed into a line of Metropolitan Police officers trying to hold it shut. He pleaded not guilty to all charges; a jury convicted him on 5/5/2023 of 11 charges, including nine felonies such as assaulting officers with a dangerous weapon, obstruction of an official proceeding, and two counts of civil disorder. U.S. District Judge Reggie B. Walton sentenced him on 10/16/2023 to 108 months of incarceration, 36 months of supervised release, a $920 special assessment, a $37,085 fine, and 200 hours of community service.

Smith attended a community gathering of roughly 50 supporters in a Lafayette County chancery courtroom in Oxford on February 21, 2025, organised by the Union County Republican Women's Club, Mississippi Conservative Coalition, and My Brother's Keeper-Oxford. He held a sign with fellow pardoned Mississippian Mike Brock requesting Governor Tate Reeves 'invite Mississippi's J6ers to dinner.' Event organisers presented commemorative plaques bearing pardoned defendants' signatures to attendees.
